Terms of Use
Last updated 15 October 2026.
These Terms of Use ("Terms") are an agreement between you and Crunchy Bagel Pty Ltd (ABN 86 609 137 162) ("Crunchy Bagel", "we", "us") about your use of the Streaks Strokes app on iPhone and Apple Watch (the "App"), including its workout packs, coaching and other content.
You accept these Terms when you agree to them in the App. If you don't agree, please don't use the App.
1. These Terms and Apple
You get the App and its in-app purchases from Apple's App Store. Your licence to use them is granted under Apple's standard Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) (the "Apple EULA").
These Terms add to the Apple EULA. Purchases are made under Apple's terms (section 5). Between you and us, if these Terms and the Apple EULA conflict, these Terms apply to the extent of the conflict. Nothing in these Terms reduces Apple's rights under the Apple EULA, or changes the scope of your licence or the usage rules in the Apple Media Services Terms and Conditions.
These Terms are between you and Crunchy Bagel only. Apple is not a party to them and is not responsible for them. We, not Apple, are responsible for the App and its content, and for dealing with any claims about the App, including product liability, consumer law, privacy and legal compliance claims, and any claim that the App infringes someone else's intellectual property. We provide maintenance and support for the App; Apple has no obligation to. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
2. Health and safety
Talk to your doctor first. Before you start rowing or any exercise program, talk to your doctor or another qualified health professional, especially if you have back, knee or hip problems, a heart condition, high blood pressure or any other medical condition, are pregnant or have recently given birth, are injured, take medication, or haven't exercised in a while.
Stop if something feels wrong. Stop straight away if you feel pain, dizziness, faintness, chest pain or discomfort, or shortness of breath. Get medical help if it doesn't pass.
Set up your rowing machine safely. Follow its manufacturer's instructions for setting it up, using it and looking after it. Put it on a stable, level surface with clear space around it. Fasten the foot straps securely before you row. Keep hands, hair, loose clothing, children and pets clear of the flywheel, chain and other moving parts. Don't use a machine that is damaged or isn't working properly.
Learn the technique first. Learn correct rowing technique before you increase your intensity, stroke rate or distance. Poor technique can strain your back, knees, shoulders and wrists. Start gently, warm up, and don't push through pain.
Some workouts need extra care. Maximum effort tests and high intensity intervals are strenuous. If you have a heart condition or high blood pressure, get medical clearance before you do them.
Read the warnings. The App shows a Health and Safety notice before your first workout on iPhone (and again if it changes). The notice forms part of these Terms. Please read it, and any other warnings the App shows you.
3. Not medical advice
The App is a general fitness product. It is not medical advice and it is not a medical device. It is not intended to diagnose, treat, cure, prevent or monitor any disease or medical condition. Workouts, targets, coaching, achievements and difficulty levels are general guidance only. They don't take your individual circumstances into account and don't replace advice from a doctor, qualified coach or other qualified health professional.
Figures are estimates. Stroke rate, pace, distance, power, heart rate, heart rate zones, energy (calories or kilojoules), durations and other figures shown or recorded by the App are estimates. They come from your rowing machine's monitor, your Apple Watch or another heart rate sensor, or are estimated by the App (for example, from your Apple Watch's motion), and depend on those devices, the details you have entered and general formulas. They may not be accurate. Don't rely on them for any medical purpose. Figures saved to Apple Health are estimates calculated the same way.
4. Exercise is at your own risk
All exercise carries a risk of injury, including strains, sprains, falls, joint and back injuries, and, rarely, heart problems, serious illness or death. These are obvious and inherent risks of exercise: some of them exist even when an exercise is done carefully and correctly, and they can't be removed by taking reasonable care.
You choose whether to exercise, which workouts to do, and how hard to work. To the extent the law allows, you do so voluntarily and at your own risk, and you accept the risks that are part of exercise. You are responsible for exercising safely and within your limits, and for the condition and safe use of your rowing machine.
Release of claims, including for our negligence. To the extent the law allows, you release Crunchy Bagel and its directors, employees and contractors from claims for injury, illness, death, loss or damage arising from exercise you do using the App, or from your use of the App, including claims based on our ordinary negligence. We accept this release for ourselves and on behalf of those people. This release doesn't cover gross negligence, reckless conduct, wilful misconduct or fraud, or any claim the law doesn't allow you to release, and it is subject to section 6.
5. Purchases and workout packs
The App is free to download. Its workout packs are one-time in-app purchases through Apple's App Store. Purchases are subject to Apple's terms, including the Apple Media Services Terms and Conditions (https://www.apple.com/legal/internet-services/itunes/).
Apple processes payments and refunds for App Store purchases. To ask Apple for a refund, go to https://reportaproblem.apple.com. If the App or a pack isn't working, please contact us. This doesn't limit any rights you have against us or Apple under consumer law (see section 6).
You can restore your purchases on your other devices using the same Apple Account. Family Sharing applies where Apple makes it available.
We may update and improve the App and its packs. We won't take away a pack you've bought unless we have to (for example, for legal or safety reasons). If that ever happens, we'll tell you in the App and, where consumer law gives you a remedy, we'll provide it.
6. Your consumer rights
Australia. The App comes with guarantees that can't be excluded under the Australian Consumer Law. You can ask Apple for a refund (section 5) or contact us.
Elsewhere. If you live outside Australia, you may have rights under the consumer laws where you live that these Terms can't take away.
What we never exclude. Nothing in these Terms excludes, restricts or changes:
- any right, remedy or guarantee under the Australian Consumer Law, or any other law, that can't lawfully be excluded or limited ("Non-Excludable Rights");
- our liability for fraud, gross negligence, reckless conduct or wilful misconduct; or
- our liability for death or personal injury caused by our negligence, where the law that applies to you doesn't allow that liability to be excluded or limited.
The rest of these Terms apply only to the extent the law allows.
7. No other promises
Apart from your Non-Excludable Rights, and to the extent the law allows, the App is provided "as is" and "as available". We don't promise that the App will be uninterrupted or error-free, that it will connect to or work with any particular rowing machine, that its figures will be accurate, or that using it will produce any particular fitness or health result. To the extent the law allows, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose and non-infringement. This doesn't affect the consumer guarantees under the Australian Consumer Law, your statutory rights under the consumer laws where you live, or any other Non-Excludable Rights.
8. Our liability
Subject to section 6:
- we are not liable for injury, illness, loss or damage to the extent it results from the risks that are part of exercise (section 4), to the extent it was caused by you not following the Health and Safety guidance in section 2 or in the App, or by the condition or use of your rowing machine, or from events outside our reasonable control;
- we are not liable for indirect or consequential loss (loss that wasn't a reasonably foreseeable result of what we did or failed to do), for incidental, special, exemplary or punitive damages (other than for conduct described in item 2 of section 6), or for loss of profits, revenue or business opportunities, since the App is for personal use; and
- our total liability to you for all claims relating to the App is limited to the greater of the amount you paid for the App and its in-app purchases in the 12 months before the claim arose, and AUD 100. This limit doesn't apply to liability for death or personal injury.
9. Your rowing machine, Apple and other services
Your rowing machine and its monitor are made and supported by their manufacturer, under its own terms. Streaks Strokes is not affiliated with or endorsed by Concept2 or any other manufacturer. We aren't responsible for your rowing machine, its monitor or their condition.
Apple Health, Apple Watch, Apple Music and iCloud are provided by Apple under its own terms. Apple Music requires your own subscription. We aren't responsible for those services or devices, for example if one is unavailable or loses data, but this doesn't limit our responsibility for the App itself. You must comply with any third-party terms that apply when you use the App, such as your Apple Music subscription terms.
10. Children
If you are under 18 (or the age of adulthood where you live), a parent or guardian must agree to these Terms for you and should read them and the Health and Safety notice with you. Anyone under 18 should row with an adult nearby.
11. Privacy
Our Privacy Policy (https://strokesrowing.com/privacy.html) explains what information the App collects and how it is used.
12. Changes to these Terms
We may update these Terms, for example to reflect changes to the App or the law. We'll publish the updated Terms at https://strokesrowing.com/terms/ and change the date at the top. If a change is significant, we'll tell you in the App and may ask you to accept it before your next workout. Minor changes apply from when they are published. A change that reduces your rights applies only once you accept it in the App. Changes don't affect claims that arose before they apply. We won't reduce your rights for purchases you've already made unless the law requires it. If you don't agree with a change, you can stop using the App.
13. Governing law and disputes
These Terms are governed by the laws of South Australia, Australia. You and we submit to the non-exclusive jurisdiction of the courts of South Australia and the courts that can hear appeals from them.
If you are a consumer living outside Australia, this doesn't take away the protection of the mandatory laws of the place where you live, or your right to bring proceedings in your local courts.
If you have a problem, please contact us first so we can try to sort it out.
